To what standard? The reason I ask is that if it was in this country as I am sure you know there are two:
1) beyond reasonable doubt - criminal
2) on the balance of probability - civil
If the case is heard in an American court, who seem to have lots of different types of rulings, and for instance the ruling were akin to 2. Is that enough? Or would you want a 1?
The same standard that found the others guilty, Vino, Tyler, Landis, etc, p1$$ in a jar, tests positive; then draw some blood, still positive? Game over.
