Hardly. As with rear end collisions between cars - the ones behind were travelling too close, so it's their fault. As any fule know

[quote="Antloony"]As one of the riders involved in saturdays accident I will say this. If I decide to ride my bike, regardless of the conditions, then I will. If I come a cropper I only have myself to blame. No one is forced to ride, no one put a gun to my head, it was my decision and mine only. I don't come here to see my friends get wound up and belittled like they're 3 olds not capable of making a sensible decision for themselves. So I fell off, big deal, I fell off and had far more injuries last year on a boiling hot summers day with no ice in sight, sh1t happens.

No wonder this country is turning into a nanny state....

What is there to discuss. If people want to ride their bikes while juggling chainsaws whilst blindfolded and drunk who are we to stop them? The onus is on us as to go for a ride or not, I'd like to think we're all mature and wise enough to make our own minds up and should the consequences of our actions not be favorable then the blame lies solely on our backs, not with ACC or any of its members be they VC's or club members who happen to be sharing the same stretch of tarmac at any given time. That's how I see it and I'm damn sure the majority, if not all will, share my view.

Hear hear, over and out.

The 'danger' of someone suing a club member is something the CTC has looked into with it's system of sections and leaders - it is a possibility but I'm not sure if it's ever been properly addressed (ie how to circumvent such an event) or even tested in a case...

However, EVERYBODY should have the correct insurance to cover this sort of thing, am I right?

If you haven't got third party insurance - get it now, from either the CTC or BC

I think the main thing is to take responsibility for our actions and remember that you can come as much a cropper tripping over the pavement...

Keep riding safely, everyone.

I understood this was a requirement of participation in club rides?

Correct.

It is in the rules of the club that you sign to say that you have read and agreed to when you complete the membership application form. If you haven't read them, do so - you've told us that you have. If you haven't got the 3rd party insurance required by the club, do so. Please. For your own protection as well as to protect your club.

Oh, and make your own decisions about whether to ride. I chose to ride last saturday, but to stick to a main road route down to the cafe, and to ride steadily. I tried to control the group I was in to ride that way, thus the frustration that has been mentioned here and elsewhere with riders not riding steadily or with consideration for others in their group by speeding up and slowing down erratically. I also chose to return (solo) via a main road route as I felt the lanes would still be icy having gone for a look at Stan Hill before coming into the cafe.

There have been cases of people suing eg:
http://www.dailyrecord.co.uk/news/scott ... -20302803/

I agree re the nanny state etc, everyone should be responsible for their own actions but the reality is that the world is changing. I think it is only a matter of time before someone in A club, maybe not ACC, gets sued in exactly these circumstances.

Yes, I remember that one - I mean, suing the CTC or club, where you have leaders or VCs.

But that case is somewhere where you need your insurance! All you need is to be a member of the CTC or BC.

[quote="Sean Hogan"]I might add....

Some ****** pal!

Sean

Why so? His pal caused him to crash. The injured bloke was paralysed for months and lost his job. What do you expect him to do? Not something a cup of tea and a slice down at the caff would clear up.

Presumably if you were being driven in a mate's car and he crashed, putting you perhaps in a wheelchair for life or able to walk but with severely impaired mental faculties so effectively unemployable, you would just get on with your changed life and not sue for damages?

That is why riding without insurance is irresponsible.

Now then!! What if a butterfly flew in your eye during a club run causing you to crash, would you sue Surrey council as they should have had precautions in place to stop the butterfly getting on the road,or the VC as he should have known there may be flying insects so NO way should you have gone out in the first place!! Just a thought

Maybe the pal came up with the suggestion that he sue him - as a means of helping him out?
